Terms of Service

Agreement
These Terms of Service ("Terms") govern access to and use of Human Behavior's websites, products, and services (the "Service") operated by Human Behavior, Inc., a Delaware corporation ("Human Behavior," "we," "us," or "our") at https://www.humanbehavior.co. By creating an account or using the Service, you agree to these Terms, our Privacy Policy, and, where we process personal data on your behalf, our Data Processing Addendum, which is incorporated into these Terms by reference.
The Service
Human Behavior provides product analytics, session replay, monitoring, and AI agent tooling. Features available to you depend on your plan and configuration. We may change, suspend, or discontinue parts of the Service with reasonable notice when practicable.
Plans, billing, and free trial
Paid plans are fixed monthly subscriptions with included usage allowances:
- Get Started — $500/mo
- Startups — $1,000/mo
- Enterprise — $2,500/mo
Quarterly billing is discounted 10% and yearly billing 20%, in each case billed up front for the period. Plans are not pay-as-you-go: you are never billed in arrears for usage, and exceeding an included allowance limits the feature rather than adding charges.
Every plan starts with a 7-day free trial. A payment method is required to start the trial, but you are not charged when you sign up: your first charge happens when the trial ends, and billing runs from that date — not from the day you created your account or whether you have finished configuring anything. If you cancel from the dashboard before the trial ends, you are not charged at all. If you choose to pay immediately instead of trialing, billing starts on that payment date.
Subscriptions renew automatically for the same billing period. You can cancel at any time from the dashboard; cancellation takes effect at the end of the current billing period. All fees are non-refundable: if you cancel during a billing period you are billed in full for that period, and no refunds or credits are provided for partial periods, unused allowances, downgrades, or periods of suspension.
You must keep a valid payment method on file during any paid subscription and you represent that you are authorized to use it. If a charge fails, you remain responsible for the uncollected amounts and we may retry the payment method and suspend the Service until payment is made in full. Fees do not include taxes; you are responsible for any applicable sales, use, VAT, or similar taxes, other than taxes on our net income.
Free trials, free features, and beta or preview features are provided without any warranty or liability on our part, and we may modify, limit, or end them at any time.
Suspension
We may suspend your or any user's access to all or part of the Service immediately if we determine that your use (including Customer Data) poses a security risk, could harm the Service, other customers, or any third party, could expose us to liability, or that you are in breach of your payment obligations. You remain responsible for fees incurred before or during a suspension and are not entitled to any refund or credit for any period of suspension.
Accounts
You must provide accurate account information and keep it up to date. You are responsible for activity under your account and for safeguarding access credentials. Notify us promptly of unauthorized use at founders@humanbehavior.co.
SMS and phone verification
You may optionally provide a mobile number for transactional SMS: one-time verification codes and, if enabled in-product, agent or account notifications. By submitting your number and completing verification, you consent to receive those messages.
Your mobile information will not be sold or shared with third parties for promotional or marketing purposes. We do not send marketing SMS. Message frequency varies. Message and data rates may apply. Reply HELP for help or STOP to cancel, or remove your number in Settings → Connections → Your phone. Consent is not a condition of purchase.
Acceptable use
You agree not to:
- Use the Service unlawfully or to violate others' rights.
- Attempt to access systems or data you are not authorized to access.
- Interfere with or disrupt the Service, or reverse engineer it except where permitted by law.
- Misrepresent your identity or affiliation, or misuse SMS or other messaging features.
To report fraud, abuse, or another violation of these Terms, use our abuse report form or email founders@humanbehavior.co.
Customer data
You retain ownership of data you submit to the Service ("Customer Data"). You grant us a limited license to host, process, and display Customer Data solely to provide and improve the Service. You are responsible for having the rights and notices needed to collect and process Customer Data through the Service. In particular, you are responsible for obtaining any end-user consents required by applicable law (for example cookie or tracking consent), and for configuring masking and privacy controls so the Service does not capture sensitive personal data (such as government identifiers, health information, or payment card data).
Where we process personal data within Customer Data on your behalf, we do so as a processor under our Data Processing Addendum.
If you are on the Get Started plan, we may additionally use and share redacted, de-identified data derived from your use of the Service — with personal identifiers and identifying content removed so it cannot reasonably be linked back to you or your users — to improve and develop our services. This does not apply on any other plan, and it does not apply during any free trial on any plan, including the Get Started trial. See the De-identified data section of our Privacy Policy for details.
Confidentiality
"Confidential Information" means non-public information one of us discloses to the other in connection with the Service, whether or not marked confidential, that a reasonable person would understand to be confidential. Ours includes non-public information about the Service, our pricing, our roadmap, and our security documentation. Yours includes Customer Data and non-public information about your business.
Each of us will use the other's Confidential Information only as needed to perform under these Terms, will protect it with at least reasonable care, and will not disclose it except to employees, contractors, advisors, and subprocessors who need it for that purpose and are bound by confidentiality obligations at least as protective as this section. Each of us stays responsible for their compliance.
These obligations do not apply to information that is or becomes public without a breach of this section, that the receiving party already knew without a duty of confidentiality, that it independently develops without using the other's Confidential Information, or that it rightfully receives from a third party without restriction.
Either of us may disclose Confidential Information where required by law or legal process. To the extent legally permitted, the disclosing party will give reasonable advance notice so the other can seek protection, and will disclose only what is required.
These obligations apply while you use the Service and for three years afterward, and continue for as long as the law protects a trade secret, and for Customer Data for as long as we retain it. This section does not limit anything expressly permitted elsewhere in these Terms or in the Data Processing Addendum, including our processing of personal data as a processor, our use of redacted, de-identified data on the Get Started plan, and our use of your name and logo in marketing.
Intellectual property
The Service, including software, branding, and documentation, is owned by Human Behavior and its licensors. These Terms do not grant you rights in our trademarks or other intellectual property except as needed to use the Service as intended. If you send us suggestions or feedback about the Service, we may use them without restriction or obligation to you.
Unless you tell us otherwise at founders@humanbehavior.co, we may identify you as a customer and use your name and logo in our marketing materials.
AI outputs
The Service uses machine learning, and AI-generated insights, summaries, and other outputs are probabilistic: they may be inaccurate, incomplete, or similar to outputs generated for others. You are responsible for evaluating outputs before relying on them, and must not treat them as legal, financial, or safety-critical advice. We have no liability for outputs or your use of them.
Disclaimer
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HUMAN BEHAVIOR AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM.
Indemnification
You will defend and indemnify Human Behavior against third-party claims arising from (a) Customer Data, including any claim that its collection or processing through the Service violates a third party's rights or applicable law (for example, missing end-user consents); (b) your use of the Service in breach of these Terms; or (c) your violation of applicable law.
Termination
You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or if needed to protect the Service or other users. Provisions that by their nature should survive termination will survive.
When a paid subscription ends, access to the Service ends under the billing terms above; your data is retained. When you delete your account, we cancel any remaining subscription and keep the data of projects you were the only member of for 90 days so the deletion can be reversed, after which we permanently delete it from our systems. Projects shared with other members stay with those members. If you delete an individual project, or ask us to delete data, we begin deleting it right away rather than holding it for that period. Providers that process data on our behalf delete their copies on their own schedules, and we may keep records the law requires us to keep. See the Retention section of our Privacy Policy for details.
Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to conflict of law principles. The state and federal courts located in Santa Clara County, California have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, and each party consents to personal jurisdiction there.
Force majeure
Neither party is liable for delay or failure to perform (other than payment obligations) caused by events beyond its reasonable control, such as natural disasters, war, terrorism, labor disputes, governmental action, or failures of the internet or third-party infrastructure.
General
These Terms, the Privacy Policy, and the Data Processing Addendum are the entire agreement between you and Human Behavior about the Service. If any provision is unenforceable, it will be enforced to the maximum extent permitted and the rest remains in effect; our not enforcing a provision is not a waiver. You may not assign these Terms without our consent; we may assign them. We may provide notices by posting on our website or emailing the address on your account, and electronic communications satisfy any writing requirement.
Changes
We may update these Terms from time to time. We will post the updated Terms on this page and revise the "Last updated" date. Continued use after changes means you accept the updated Terms.
